Agricultural Districts

New York’s Agricultural Districts Law, Article 25-AA PDF of the NYS Agriculture and Markets Law, was enacted in 1971 to help keep farmland in agricultural production.

Agricultural Districts are designed to protect agriculture through a combination of landowner incentives and protections that discourage the conversion of farmland to non-agricultural uses, including:

  • providing reduced property tax bills for agricultural lands - property owners must apply annually with their local assessor for an agricultural assessment
  • providing the framework to limit unreasonable local regulation on farm practices
  • providing Right to Farm provisions that protect agriculture from private nuisance suits
  • modifying state agency administrative regulations and procedures to encourage the continuation of farm businesses
  • modifying the ability to advance public funds to construct facilities that encourage development
  • preventing benefit assessments, special ad valorem levies, or other rates and fees on agricultural lands for the finance of improvements such as water, sewer or nonfarm drainage
  • modifying the ability of public agencies to acquire farmland through eminent domain

Agricultural Districts primarily benefit owners of land that is farmed.  Being part of an Agricultural District does not:

  • directly affect the use of land beyond existing requirements, for example, zoning; or
  • directly reduce or increase tax assessments—agricultural landowners can apply to the local tax assessor for an annual agricultural assessment.

Eight-Year Recertifications

Agricultural Districts are reviewed and recertified every eight years (schedule and District map below). During the review landowners can decide if they want their property to remain in the District, or be removed or added. Owners of property within the Agricultural District will receive a mailed written notice of review. Public notices and announcements are also published.

Annual Additions

Landowners can request to have their property added to an Agricultural District during the annual additions process. Property can only be removed from an Agricultural District during the eight-year review and recertification process described above.

Frequently Asked Questions

My land is not used for farming, what happens if it's in the District?

Ag Districts primarily benefit owners of land that is farmed. Being within a District does not have any direct implications for owners of land not used for agriculture. It will not directly affect tax assessments or limit use of the land beyond existing requirements, for example, zoning.

Why is my land in an Agricultural District?

Ag Districts in Onondaga County were first formed in the 1970's and included agricultural areas with land owners that requested and supported District formation. When first formed, Ag Districts were "contiguous," that is, all properties within an outermost boundary that encompassed the majority of interested farms were included, regardless of their use. Land typically remained in the District over subsequent recertifications unless the owner at the time of recertification specifically requested that it be removed. Property is not automatically added or removed when it is bought or sold.

How can I add or delete my land from a District?

Property can be added to Agricultural Districts on annual basis. Onondaga County accepts requests during January of each year. Property can only be deleted from a District during an eight-year review and recertification process.

Can I get a reduction in my property taxes?

Agricultural Districts do not directly affect property tax assessments. All properties that meet New York State requirements can apply for an annual agricultural assessment, regardless if it is in an Agricultural District or not. You cannot receive an agricultural assessment if your land does not meet New York State agricultural production requirements. For more information contact your local town assessor.
