| The Onondaga Nation filed its declaratory judgment
action on March 11, 2005 in the United States District Court for the Northern
District of New York, naming Onondaga County, New York State, Governor
Pataki, the City of Syracuse, Honeywell, Trigen Syracuse Energy Corporation,
Clark Concrete, Valley Realty Development Company and Hanson Aggregates
North America.
The Onondagas claim ownership rights to a corridor of land extending from the Canadian border to the Pennsylvania border and including Onondaga County. The suit seeks to declare certain specific conveyances in the land claim area, dating from the Eighteenth and Nineteenth century, null and void. The Onondagas have publicly stated that they are not interested in ejecting persons from their property and have not named private non-corporate landowners in the suit. However, they have stated an interest in becoming involved in environmental improvements in Onondaga County, including Onondaga Lake and its tributaries, and obtaining monetary compensation. The County is treating the claims of the Onondagas with the utmost seriousness and intends to protect the rights and interest of all County residents as this suit makes its way through the courts.
